In those circumstances:

  • the agency owner is generally the business or organization responsible for the recruiting relationship;

  • Piper Financial Group may provide administrative, technical, CRM, workflow, configuration, maintenance, support, and related services;

  • Piper Financial Group may have technical or administrative access to information within the sub-account when reasonably necessary to provide those services; and

  • HighLevel and its applicable service providers may process the information as technology providers supporting the platform.

Piper Financial Group may configure these accounts using templates, workflows, automation structures, CRM processes, pipelines, forms, campaigns, communications, and similar resources based upon systems developed by Piper Financial Group.

Individual sub-accounts may then be customized to reflect the agency's:

  • name;

  • logo;

  • brand identity;

  • contact information;

  • messaging;

  • communication style;

  • recruiting process;

  • team;

  • calendar;

  • workflows; and

  • business practices.

Responsibility for Sub-Account Data

Unless otherwise expressly agreed, an agency owner using a sub-account is responsible for the personal information the agency collects through that sub-account.

The agency owner is responsible for determining:

  • what information to collect;

  • why the information is collected;

  • who should receive communications;

  • how recruiting information is used;

  • who within the agency receives access;

  • how long information should be retained;

  • whether information should be exported or deleted; and

  • what communications are sent to the agency's contacts.

Piper Financial Group may process or access such information when reasonably necessary to:

  • establish or configure the sub-account;

  • provide technical assistance;

  • troubleshoot platform issues;

  • maintain workflows;

  • administer the platform;

  • manage security;

  • respond to lawful requests;

  • maintain platform functionality;

  • investigate misuse; or

  • provide services requested by the agency.

12. Responsibilities of Agencies Using the Platform

Each agency, agency owner, agent, recruiter, or other authorized organization using a Piper Financial Group-provisioned sub-account is responsible for using the system lawfully.

This includes responsibility for:

  • collecting personal information lawfully;

  • providing legally required privacy notices;

  • obtaining appropriate consent;

  • maintaining evidence of consent where appropriate;

  • complying with applicable calling and texting laws;

  • complying with the Telephone Consumer Protection Act and implementing regulations where applicable;

  • complying with CAN-SPAM and other applicable electronic communication laws;

  • honoring unsubscribe and opt-out requests;

  • complying with applicable state privacy and consumer protection laws;

  • using call-recording functionality lawfully;

  • recruiting sequences;

  • notifications;

  • task assignments;

  • pipeline updates; and

Automated communications may be triggered by actions such as:

  • submitting a form;

  • requesting information;

  • scheduling an appointment;

  • responding to a message;

  • reaching a particular recruiting stage;

  • failing to complete an expected action; or

  • other workflow criteria.

Use of automation does not eliminate the responsibility of Piper Financial Group or the applicable agency to comply with applicable communication, consent, and privacy laws.

Piper Financial Group does not control the privacy practices of third parties.
